The Mediated Prenup or Postnup

Our most popular service is the mediated prenuptial agreement (or mediated postnuptial agreement). This service includes both partners.

Our process for a mediated prenup or postnup is streamlined into one flat fee: $2,495. Mediation occurs through a divorce litigator and former family court magistrate turned mediator, who drafts your agreement, and a Relationship Coach, MS/lawyer turned mediator.

Do You Qualify for the $2,495 Mediated Prenup (or Postnup)?

You qualify for the $2,495 mediated prenup or postnup if you both:

  • Do not own a business. Pricing for business owners is in the second box above.
  • Complete our intake questionnaire, and then schedule your free initial Zoom consultation via Calendly.
  • Attend the free initial Zoom consultation (15-30 minutes) with camera and microphone on.
  • Commit to two (2) separate mediation sessions and one (1) disclosure tutorial session.  All sessions occur on Zoom.
  • Sign a confidentiality agreement before beginning your mediation sessions.
  • Affirm that you are not under investigation for any criminal act or by a taxing authority.

There will be added charges to the $2,495 fee for more time and labor if one or both of you:

  • Possess an existing will or trust that predates the prenuptial (or postnup) agreement.
  • Earn the bulk of your income through business ownership: see the second box above.

Not everyone’s financial picture is straightforward, but we can still help you in the following situations if you are willing to commit to an additional mediation session. If you need language for:

  • Protecting business ownership: the fee may be an additional $495 – $2,495 depending on the scope of your business and the labor required for drafting.
  • Referencing and prioritizing previously drafted wills, trusts, and other instruments: the fee may be an additional $495 – $795 depending on the complexity of the instruments and assets.
  • Indemnifying and protecting a partner from the effects of active litigation against the other partner: the fee is usually an additional $495.
  • Referencing pending domestic real estate purchases: the fee is usually an additional $295.

Traditional Representation: Drafting Your Prenup or Postnup

This service offers the traditional attorney-client relationship for one partner only; the other partner must obtain separate counsel.

JustPrenups will write your customized prenup/postnup as your attorney and present it to your partner/partner’s lawyer. This service also starts with a free confidential meet-and-greet session so that we can learn about each other.

Traditional Representation: Reviewing Your Prenup or Postnup

Just like above, this service offers the traditional attorney-client relationship for one partner only – in this case, for the partner who has received a draft of the prenup from the other partner’s attorney.

The attorney offers a confidential review of the agreement and provides commentary regarding what is in your best interests as well as answers to specific questions. The attorney will also suggest some language that can be beneficial to you for specific revisions.

This service starts with a free confidential meet-and-greet session via Zoom so that we can learn about each other. After we receive your prenup/postnup draft, JustPrenups will review the number of pages, the number of issues referenced, and the types of recommended revisions. We then provide pricing via email.

Please alert us if the situation is time-sensitive, as we can accommodate a faster email-only turn-around to suit your schedule.

Help for Florida Newcomers with an Existing Out of State Prenup

Welcome to the Sunshine State!

Do you have an existing prenup or postnup from another state or country, but you now call Florida home? The attorney can evaluate your existing prenup or postnup for its effectiveness in Florida. If you haven't figured it out by now, Florida is quirky.

  • Did you know that Florida is one of six states that does not recognize separation? In Florida, you're either married or filed for divorce. There is no in between.
  • Did you know that in Florida, equal timesharing (i.e., child custody) is presumptive?
  • Did you know that in Florida, business interests can be named as a party in a divorce and for practical purposes are deemed "guilty until proven innocent" of wrongdoing under our bizarre holding in Zold v. Zold?
  • Did you know that in Florida, the richer spouse pays the poorer spouse's attorney's fees?
  • Did you know that in Florida, temporary attorney's fees and temporary alimony cannot be waived by prenup?
  • Did you know that Florida requires "full and frank" disclosure for a prenup to be valid?

Your out of state prenup may not adequately address the concerns above. In addition, if you are a member of a same-sex couple, additional protection can be added to your new Florida prenup addressing future legislative action targeting same-sex marriage.

This help for Florida newcomers is offered through mediation for both partners together or through the traditional attorney-client relationship for one partner only.

After we receive your existing prenup or postnup, the attorney can determine if it needs only partial revision or a full rewrite. Your agreement may or may not meet the disclosure requirements, and JustPrenups can also assist with facilitating your compliant disclosure process.

Premarital Financial Indexing

Our other name for this service is, "Oops, I Forgot a Prenup." If your wedding is quickly approaching and it's too late to draft a valid, enforceable prenup, this product may be your solution.

Thanks for considering JustPrenups.

It would be an honor to have your trust and to help you achieve your goals.
